IMPORTANT – PLEASE READ CAREFULLY: These Terms of Service ("Terms," "Agreement") constitute a legally binding agreement between you ("Client," "you," "your") and Tony Capo (operating through the website tonycapo.net), an offensive cybersecurity company specializing in mobile device technology ("Company," "we," "us," "our"). The terms "Tony Capo," "tonycapo.net," and associated branding refer collectively to the brand, the business entity, and the individual principal, Tony Capo.

By accessing our website, tonycapo.net, or by engaging, purchasing, or agreeing to any services offered by the Company (the "Services"), you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree to these Terms, you must not access our website or use any of our Services.

1. Services Offered
Tony Capo provides offensive cybersecurity services, including but not limited to penetration testing, vulnerability assessments, security consulting, and related research, with a specialization in mobile device technology. All Services are intended for legitimate, ethical, and legal purposes only, such as authorized security testing with explicit permission from the asset owner.

2. Client Representations and Warranties
By using our Services, you represent and warrant that:

• You are at least 18 years of age and have the legal capacity to enter into a binding contract.

• You will use the Services only for lawful purposes and in compliance with all applicable local, state, national, and international laws, rules, and regulations.

• You have obtained all necessary authorizations, consents, and permissions for the systems, networks, and devices that are the subject of the Services. You are solely responsible for ensuring that your use of our Services is authorized.

3. Prohibition of Illegal Services
Tony Capo.net does not and will not openly violate any laws in any jurisdiction. We reserve the absolute right to refuse, cancel, or terminate any service request that we believe, in our sole discretion, is illegal, unethical, or intended for malicious purposes, including but not limited to unauthorized hacking, data theft, espionage, or any activity that infringes upon the rights of others. Any request for such illegal services may be refused without explanation.

4. Payment and Settlement of Claims
Payment for Services constitutes a full and final settlement of any and all claims, disputes, complaints, or legal issues, whether known or unknown, that you may have or may have had against the Company arising from or related to the Services provided. Upon receipt of payment, you agree that any such matters are considered fully and finally resolved.

5. Indemnification
You agree to indemnify, defend, and hold harmless Tony Capo, the brand tonycapo.net, its officers, agents, partners, and employees from and against any and all claims, damages, obligations, losses, liabilities, costs, debt, and expenses (including but not limited to attorney's fees) arising from:

• Your use of and access to the Services.

• Your violation of any term of these Terms.

• Your violation of any third-party right, including without limitation any copyright, property, or privacy right.

• Any claim that your use of the Services caused damage to a third party or violated any law.

This indemnification obligation will survive the termination of this Agreement and your use of the Services.

6. Limitation of Liability and Disclaimer of Warranties
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, THE SERVICES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. THE COMPANY EXPRESSLY DISCLAIMS ALL WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

THE COMPANY SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM YOUR USE OF THE SERVICES. IN NO EVENT SHALL THE AGGREGATE LIABILITY OF THE COMPANY EXCEED THE AMOUNT YOU PAID TO THE COMPANY, IF ANY, FOR THE SERVICES GIVING RISE TO THE CLAIM.

7. Governing Law and Exclusive Jurisdiction
This Agreement shall be governed by and construed exclusively in accordance with the laws of the Republic of Albania, without regard to its conflict of law principles.

Any and all disputes, claims, or legal proceedings arising out of or relating to these Terms, the Services, or the relationship between the Client and the Company (including non-contractual disputes or claims) must be brought exclusively in the courts of the Republic of Albania.

By agreeing to these Terms, you irrevocably submit to the personal and exclusive jurisdiction of the courts of the Republic of Albania for the purpose of resolving any such dispute. You hereby waive any and all objections to the exercise of jurisdiction over you by such courts and to venue in such courts, including objections based on inconvenient forum.

8. Modifications to Terms
We reserve the right, at our sole discretion, to modify or replace these Terms at any time. We will provide notice of material changes by posting the new Terms on our website. What constitutes a material change will be determined at our sole discretion. By continuing to access or use our Services after those revisions become effective, you agree to be bound by the revised terms.
